Terms and Conditions

We have the right to revise and amend these Terms and Conditions from time to time and you will be subject to the terms and conditions in force at the time that you order products from us.

It is Contemporary Cravats' policy to treat our customers in the way we like to be treated ourselves. Nobody likes small print but we aim to give you all the information you need to feel protected and confident in our services.

Formation of Contract:

After placing an order, you will receive an email from Paypal acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us. All orders are subject to acceptance by us and we will confirm such acceptance to you by sending you an email that confirms that your order has been dispatched. The contract between us will only be formed when we send you the dispatch confirmation email. We may choose to reject a customers offer of purchase if we feel that we cannot supply you with the standard of service necessary to comply with our terms and conditions.

Supply:

Unless we have specifically agreed otherwise, delivery will be within three to four days of our dispatch confirmation email within the UK. If you have an urgent order it is always advisable to telephone us to discuss your requirement and we will endeavour to supply the goods by any date you might reasonably request. Please recognize that we do rely on external carriers for delivery. The products will be at your risk from the time of delivery.

If we choose to make a contract of sale to be delivered to outside of the UK, we shall contact you prior to dispatch to give details of the additional postage costs that you will be liable for.

In the event of us not being able to supply you with the goods promptly, or the design is no longer available, we shall contact you to discuss your order. We shall not be able to dispatch any items until we hear back from you. If you are no longer interested in placing an order, we shall return full payment.

Cooling Off Period:

You have a right to cancel your contract with us within seven working days of the day that you receive the goods ordered. If you wish to cancel a contract, you must inform us in writing and return the product to us immediately in the same condition in which it was received, in which case we will provide a full refund of the price paid in accordance with our refunds policy. This provision will not affect your statutory rights.

Liability / Guarantee:

We hope that you will be totally satisfied with your order. Our liability in connection with the product will be strictly limited to the purchase price. This does not limit in any way our liability for death or personal injury caused by our negligence; for fraud or fraudulent misrepresentation; or under section 2(3) of the Consumer Protection Act 1987. We accept no liability for loss of income or revenue, loss of profits or contracts or any indirect or consequential loss or damage of any kind howsoever arising and whether caused by tort (including negligence) , breach of contract or otherwise, even if foreseeable.

Force Majeure:

We will not be liable or responsible for any failure to perform, or delay in performance of any of our obligations that is caused by events, acts, omissions or accidents outside our control, including, but not limited to: strikes or other industrial action, civil commotion, invasion, terrorist attack, war, fire, storm, flood, earthquake, or other natural disaster, impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport. We will use our reasonable endeavors to find a solution by which our obligations may be performed in such an event.

Law and Jurisdiction:

Any contract for the purchase of products through our site will be governed by English law and any dispute arising from the contract will be subject to the non-exclusive jurisdiction of the courts of England and Wales.

Data & Privacy:

The information collected from you at the time you place an order will be stored in our database and is used purely to carry out your instructions and action your payment. We will only contact you in connection with your order.

Refunds:

When you return a product to us, we will examine the returned product and notify you of the refund via email as soon as possible. The refund will be by the same method used by the customer to pay for the purchase. If the product is returned because of a defect, we will refund the price paid in full plus the reasonable cost to you of returning the product. However, if the product is returned as a result of the cooling off period, then we will refund the price paid but you will be responsible for the cost of returning the product to us.

In the event of loss of the product in transit where a replacement is not acceptable, a full refund will be sent after we are assured that the product was not lost by your hand and it was the responsibility of the carrier. In the event of late delivery where a replacement is not acceptable, a full refund will be sent on the return of the product to us.

If the goods ordered were a gift to a third party, the parcel is sent with a note showing our contact details so that the third party contact us independently if they have a query about the product itself.

If we have sent you an incorrect item, please contact us as soon as possible and return the incorrect item to us and specify the correct details in writing. If you would like us to replace the incorrect item we will send you a replacement as soon as possible. We will not charge you for the incorrect item and will reimburse your reasonable costs in returning it.

Payment:

Payment is received automatically through our paypal account, for further information on their procedure please visit their website at www.paypal.com. It is in our best interest and also yours if we cease the order and return payment if we believe that your details were incorrect. The price of the product will be as quoted on our site from time to time, except in the case of obvious error. The prices include VAT. Prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent you a dispatch confirmation email.

Complaints:

Clearly we take any complaint very seriously and we will try to contact you within 24 hours. Please note that at Christmas time there may be some delay in our response.
